SMS consent and TCPA basics

Automated texting in the US is governed by the TCPA and carrier rules. The practical requirements are consent, identification, opt-out, and records. This is general guidance, not legal advice.

Collect express written consent

  • Use an unchecked checkbox on every form that collects a phone number.
  • State clearly that the person agrees to receive automated texts, that consent is not a condition of any service, and that message and data rates may apply.
  • Link your privacy policy and terms next to the checkbox.
  • Store what was agreed, when, and from which page — the widget records this automatically.

Identify yourself in the first message

The first outbound text should name you and your brokerage and explain why you are messaging. Include opt-out instructions at least in the first message of any campaign.

Honour opt-outs immediately

  • STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT stop all future sends automatically.
  • Never re-add an opted-out number to a follow-up sequence.
  • HELP returns your contact details.

Respect timing and frequency

  • Send between 8am and 9pm in the recipient's local time; some states are stricter.
  • Cap follow-ups on a quiet lead — a small number of spaced messages, then stop.
  • Check state-level rules; several states have their own mini-TCPA statutes with tighter consent requirements.
UK and EU senders

Outside the US, PECR and GDPR apply instead. You need a lawful basis, a clear opt-in for marketing messages, and an easy opt-out in every message.
